ORAL ORDER:

This writ petition is filed praying to grant the following relief: ".....to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in discontinuing the petitioner, without any reason, in the post of Teaching Assistant / Academic consultant in the 2nd respondent College and not applying Career Advancement Scheme as illegal arbitrary, capricious and violation of the Articles 16, and 19(1)(g) of the Constitution of India and consequently direct the respondents to continue the petitioner in the post of Teaching Assistant / Academic consultant in the Department of History of the 2nd respondent College, until the regular process of recruitment is initiated for filling up of the existing vacancies"

This Court on 1.4.2011 passed the following order in WPMP No. 10931 of 2011.

"If the second post of Teaching Assistant/Academic Consultant in the department of History in Sri Venkateswara University is approved for sanction, the services of the writ petitioner be continued as such. Notice."

On further representation, this Court issued clarification by order dated 25.4.2011. The clarification reads as under: "It is pointed out by the learned counsel that because of the usage of the expression " Second post" in the order passed by me on 1-04-2011 in WPMP. No. 10931 of 2001, the respondent - University has not continued the services of the writ petitioner.

It is clarified that if both the posts of Teaching Assistant/Academic Consultant in the department of History in Sri Venkateswara University, as approved by the University, are vacant, the services of the petitioner be continued as such."

When the matter is taken up, learned counsel for petitioner submitted that in pursuant to the interim order, since another post of Teaching Assistant/ Academic Consultant was available, petitioner is being continued and is working in the said capacity. Since he is continuing as on today, he submits that no further orders are required. 5.

Recording the submission of the learned counsel for petitioner, the writ petition is closed. No costs.
