THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO TRANSFER CRIMINAL PETITION No.42 of 2013 ORDER:

This petition has been moved by the petitioner/husband seeking transfer of the M.C.No.4 of 2011 filed by the 2nd respondent/wife pending on the file of Additional Judicial First Class Magistrate, Sangareddy, Medak District to IX Metropolitan Magistrate, Kukatpally, Miyapur at Cyberabad. On behalf of the 2nd respondent Sri K.Mohan Rami Reddy, learned counsel has pointed out that M.C.No.4 of 2011 was already decided by the learned Additional Judicial First Class Magistrate, Sangareddy, Medak District on 19.03.2012 by ordering the petitioner to pay a sum of Rs.3,000/- p.m towards maintenance from the date of the petition and that the arrears shall be paid within six months from the date of the said order. Sri K.Mohan Rami Reddy, learned counsel, would also submit that the petitioner herein has filed Crl.R.C.No.164 of 2014 before this Court on 12.09.2012.

It is, therefore, clear that the present Transfer Criminal Petition is misconceived and it is not maintainable having been preferred to this Court after M.C.No.4 of 2011 was decided by the learned Additional Judicial First Class Magistrate, Sangareddy, Medak District on 19.03.2012. Hence, the Transfer Criminal Petition is dismissed imposing costs of Rs.500/- payable to the 2nd respondent by the petitioner within a period of 30 days from the date of receipt of a copy of this order.
