THE HON'BLE SRI JUSTI CE SURESH KUMAR KAI T & THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T APPEAL No.810 of 2018 JUDGMENT: (per Hon'ble Sri Justice Suresh Kumar Kait) The present appeal is filed against the order, dated 07.06.2018, passed by the learned single Judge of this Court in W.P.No.18735 of 2018, whereby the learned single Judge directed to post the matter after two weeks at request.
Though there is no adverse order passed against the appellants, however, the case of the appellants are that vide notification, dated 21.03.2017, the respondents intend to recruit Sweepers in Districts Kurnool and Anantapuram. The appellants are working from 2014-15, however, without putting notice to the petitioners, the respondents issued notification, mentioned above.
After hearing the matter for some time, it is agreed by the counsel for the parties that the appellants shall not be disturbed from service until the final recruitment is made pursuant to the notification, dated 21.03.2017.
It is not in dispute that there is a bipartite settlement, dated 19.10.1966, and as per Clause-20.6, the recruitment will be subject to a bank's recruitment rules, if any, part-time employees will be given preference for filling of full-time vacancies, other things being equal. Therefore, we are of the considered opinion that at the time of recruiting Sweepers, as per the notification, dated 21.03.2017, the said clause-20.6 of bipartite settlement, dated 19.10.1966, shall be taken into consideration.
SKK,J & AKS,J WA_810_2018 Accordingly, the writ appeal is disposed of. Consequently, W.P.No.18735 of 2018 stands disposed of. Needless to state that the case of the appellants shall be considered in terms of the bipartite settlement, dated 19.10.1966. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
