. This Criminal Petition is hled under Sections 482 of the i Code of Criminal Procedure, 1973 (for short ,Cr.p.C.J by petitioners-accused Nos.l and 2 seeking to quash the proceedings in C.C.No.1416 of 2Ol7 on the file of the learned IX Metropolitan Magistrate, Kukatpally, registered for the offences punishable under Sectio ns 42O,406 and 506 of the Indian Penal Code (for short 'IPCJ.

02. When the matter has been taken up for hearing, on 08.11.2023 none appeared on behalf of the petitioners and the matter has been directed to be listed today under the caption 'for dismissal'.

03. Even today, there is no representation on behalf of the petitioners. Status of case before the trial Court is not known.

04. This matter is of the year 2Ol8 and the CC is of the yea.r 2017. No interim orders were passed by this Court.

05. This Court after taking into account the fact that petitioner No.l is aged about 65 years and petitioner No.2 is aged about 72 years at the time of filing this criminal petition and as both petitioners are Senior Citizens, the attendance of petitioners-accused Nos.I and 2 is dispensed with in C.C.No. 1416 of 2OIZ on the hle of the learned IX Metropolitan Magistrate, Kukatpally, when represented by their counsel on record. The attendance of the petitioners is dispensed with subject to filing an affidavit by the petitioners stating that in their absence, the proceedings conducted by their counsel will not be disputed by them in any manner and shall not dispute their identit5z a1so. However, the petitioners shall appear before the learned Magistrate as and when their presence is required. In the event of failure of the petitioners to appear when the Court directs, this Order ;

I dispensing with their attendance shall stand cancelled.

06. Accordingly, the Criminal petition is disposed off. Needless to say, in the event of the petitioners fiIing an application seeking discharge if charges are not framed, the concerned Court shall dispose it of on merits within a period of four (O4) weeks.
