THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6662 OF 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused for grant of anticipatory bail in the event of his arrest in connection with Crime 273 of 2019 of Jangaon Police Station, Warangal Commissionerate, registered for the offence punishable under Section 307 I.P.C.

Heard learned counsel for the petitioner/Accused, and the learned Additional Public Prosecutor representing the respondentState. Perused the record. 3.
The allegation levelled against the petitioner is that on 30.06.2019 when the husband of the complainant went to labour adda for daily work as usual, the petitioner quarreled with him for questioning the petitioner as to why he was abusing the person, with whom he was talking on phone and stabbed the husband of the complainant with a knife, thereby causing bleeding injuries on stomach and back and committed the aforesaid offence. 4.
Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused 5.
Learned counsel for the petitioner would submit that the petitioner is an innocent person and falsely implicated in this case; that even as per the investigation, the injuries are simple in nature; that the petitioner never the committed the offence as
alleged in the complaint and hence, he prays to grant bail to the petitioner.

As per the investigation, though the injuries are simple in nature, however, looking into the nature of injuries, place of injuries and the weapon used by the petitioner in inflicting the injuries to the victim, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for Anticipatory bail is rejected. However, if the petitioner/Accused surrenders before the Court concerned within ten (10) days from today and moves an application for grant of bail, after issuing prior notice to the Public Prosecutor, the same shall be considered by the Court concerned in accordance with law.

With the above observation, the Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending in this petition shall stand closed.
