THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition Nos.5089 and 5118 of 2009 COMMON ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) None appears for the petitioners.

The action of the 1st respondent, in not permitting the University employees to contest the elections or for taking part in politics, is questioned in these writ petitions as being illegal and arbitrary. The petitioners, an Associate Professor and a Professor (Philosophy) in Osmania University, have filed these Writ Petitions seeking permission to participate in the elections for the Graduate Constituency of the Legislative Council in the elections held in the year 2009.

After the election held for the legislative assembly in the year 2009, the term of the office of its members expired and the subsequent elections were also held in 2014. We see no reason, therefore, to examine the legal contentions raised in these writ petitions. Leaving it open for such questions to be adjudicated in appropriate legal proceedings, the writ petitions are dismissed as infructuous, as the cause in the writ petitions no longer survives. The Writ Petitions are, accordingly, dismissed as infructuous. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
