THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23036 of 2019 O R D E R:

Though the petitioner asserts that the bid submitted by it for award of a contract with respect to laying of CC roads and CC drains, in all respects, is a responsive bid, a perusal of Condition No.3.1(m) of the Instructions to Tenderers shows that there is a requirement of submitting the particulars with respect to the proposed methodology and programme of construction, backed with equipment planning and development, duly supported with broad calculations, justifying their capability of execution and completion of the work as per the technical specifications within the stipulated period of completion as per milestones. Admittedly, as the petitioner has not complied with the aforestated Condition, which has been notified as essential condition for consideration of a valid bid, no explanation can be expected by the tendering authority after submission of the bid. Though the learned counsel for the petitioner submits that such condition is obnoxious, there being no challenge to the said condition, the same cannot be considered.

In those circumstances nothing remains in the writ petition and it is accordingly closed.
