The petitioners herein are defendants 1 and 2 in O.S.No. 177 of 2013 on the file of the Prl. Junior Civil Judge, Chirala. The plaintiff filed I.A.No. 2628 of 2013 seeking temporary injunction against the defendants restraining them from interfering with peaceful possession and enjoyment of the plaintiff over the suit schedule property. The trial Court dismissed the said application, against which the plaintiff filed CMA No. 1 of 2014 before the Senior Civil Judge, Chirala who, under the impugned order, allowed the said appeal and granted temporary injunction as prayed for. Aggrieved thereby, the present revision petition is preferred.
I have heard learned counsel for the parties and found no illegality or irregularity in the impugned order, hence warrants interference by this Court. The impugned order of injunction was passed by the lower appellate court against the petitioners/defendants as early as on 2.6.2014 and it has been operative since then. Therefore, at this stage due to passage of time, it would not be just and proper to interfere with the impugned order, instead it is appropriate to direct the trial Court to hear and decide the suit as expeditiously as possible by or before end of December, 2015.
