Shortfall Letter dated 03.08.2019 issued by respondent No.2Additional Chief City Planner, Greater Hyderabad Municipal Corporation, Hyderabad intimating the petitioner that his application cannot be considered for grant of building permission is challenged before this Court.

Heard learned counsel for the petitioner and learned Standing counsel for the respondents.

One of the principal grounds urged by the petitioner is that though he made an application for grant of building permission with respect to plot bearing No.41/2 of Khanamet Village, Serilingampally Mandal, Ranga Reddy District, the rejection is with respect to Survey No.14/14 of Khanamet Village, which is Government assigned land. As there is an obvious mistake in considering the application of the petitioner, the writ petition is allowed and the impugned Letter is set aside. However, liberty is given to the petitioner to resubmit the application, which shall be processed by the respondents by taking into consideration the amounts paid initially for the purpose of granting building permission. The entire exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
