HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4940 OF 2017 ORDER:

This writ petition is filed declaring the action of the respondents in not conducting survey and fixing the boundaries in respect of the land in Sy.Nos.74, 75 and 76 of Kongarkalan, Mangalapally and Patelguda Villages of Ibrahimpatnam Mandal, Ranga Reddy District, as illegal and arbitrary. Heard both sides.

By way of interim application the petitioners are seeking for cancellation of panchanama dated 01.12.2014. But the same relief is not challenged in the writ petition. If any survey is conducted and the petitioners are aggrieved by the same, the petitioners have to approach the appellate authority as per Section 10 and 12 of the Andhra Pradesh Survey and Boundaries Act, 1923. In view of the same, no relief can be granted in this writ petition.

Accordingly, the writ petition is dismissed granting liberty to the petitioners to avail alternate remedy of appeal seeking cancellation of panchanama dated 01.12.2014. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
