HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G. SHYAM PRASAD Writ Petition No.43339 of 2016 ORDER: (per V. Ramasubramanian, J.) The petitioner has come up with the above writ petition challenging an auction notice issued by the Bank.

2. The petitioner has an effective alternative remedy before Debts Recovery Tribunal, Visakhapatnam Bench. Till 3rd November, 2016, the Tribunal was not functioning. But from 03-11-2016, the office has started functioning. The impugned notice is dated 18-112016. Since the auction is posted on 21-12-2016, the petitioner has gratuitously come up with the above writ petition unlike the other persons, who come up with the writ petition on the last date of auction.

3. Therefore, leaving it open to the petitioner to move Debts Recovery Tribunal, Visakhapatnam Bench, the writ petition is dismissed.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
