Heard Mr.Venkateswarlu Sanisetty for petitioner, Mr.Ravi Chimalapati, Mr.T.G.Prasad Reddy and Mr.M.Shiva Prasad Reddy representing Mr.V.Venu Gopala Rao.

The petitioner prays for the following relief: "...Writ of Mandamus, to declare the action of the respondents in not preventing the encroachments of communal site of Ac.

0.39 cents situated at Venkatapuram Village and Panchayat, Eluru Mandal, West Godavari District, left over as per the approved layout as being illegal and consequently direct respondent No.4 herein to sell the excess site from out of the total extent of Ac. 0.39 cents to the petitioner on payment of market value by cancelling the Enjoyment Certificate issued..."

The counsel for petitioner submits that during the pendency of the writ petition, the 4th respondent has substantially redressed the grievance and also continuing to take steps to protect the site earmarked for communal utility. The learned standing counsel endorses the submission of petitioner.
