THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38333 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 3rd respondent in registering the FIR No.80 of 2016, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioners is that the 4th respondent lodged the present complaint against the petitioners alleging that on 03.06.2016, when the 4th respondent asked the 1st petitioner as to why he scolded the relatives of the 4th respondent, then the petitioners beat the 4th respondent and hence, the 4th respondent lodged the present complaint against petitioners. The grievance of the petitioners is that a false case is foisted against them only with political motive.

Learned counsel for the petitioners submitted that the petitioners as well as the 4th respondent are students and that the arrest of the petitioners would certainly cause prejudice for their future. Considering the grievance of the petitioners and the submissions of the learned counsel for the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.80 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to report before the 3rd respondent daily between 10.00 a.m. and 5.00 p.m. from19.11.2016 to 25.11.2016. The petitioners are further directed to execute a personal bond for a sum of Rs.

5,000/- (Rupees five thousand only) each with one surety each to the satisfaction of the 3rd respondent as surety for their future appearance as and when required for the purpose of investigation.
