HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 7593 OF 2008 ORDER:
Heard Smt.Hema Jaiswal, learned counsel for the petitioner and learned Government Pleader for Revenue.
The present Writ Petition came to be filed seeking to direct the respondents to sanction freedom fighters pension to the petitioner and declare the proceedings of the respondents issued vide letter No.52/CC/1032/98FF(HC), dated 14.05.2002, as illegal and arbitrary and consequently set aside the same.
On 27.04.2009, this Court, while issuing rule nisi, directed the respondents to consider and sanction pension by disposing of the representation purported to have been filed by the petitioner under Freedom Fighters Pension Scheme, as per law, within a period of four weeks from the date of receipt of a copy of that order and communicate the same to the petitioner.
In view of the above, the question of again directing the respondents for sanctioning freedom fighters pension does not arise. Hence, the Writ Petition is disposed of giving liberty to the petitioner to avail remedies available under law, in case the representation made and considered pursuant to the order dated 27.04.2009 is rejected. In case the order dated 27.04.2009 is not complied with, the respondents are directed to pass appropriate orders on the petition, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the present Writ Petition is disposed of. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
