CVNR, J WP 13909/2007 ORDER:

This writ petition is filed for a mandamus to set aside Memo No.DEE/OP/BGR/ADM/D. No.173/2003, dated 15.11.2003, of respondent No.2.

At the hearing, there is no representation for the petitioner. Mr. R. Vinod Reddy, learned counsel for the respondents, submitted that the petitioner was only a Contract Junior Lineman, whose contract even in normal course would have expired on 26.06.2004 but for the impugned order of termination.

A perusal of the record shows that no interim order was granted at the time of admission of the writ petition. As the petitioner is out of service for the last nine years and his tenure of contract would have ended on 26.6.2004 even in the absence of the impugned order, the petitioner is not entitled to any relief in this writ petition. Hence, the writ petition is dismissed.

As a sequel to dismissal of the writ petition, W.P.M.P. No.17450 of 2007 shall stand disposed of as infructuous.
