THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18919 OF 2012 ORDER :

It is the case of the petitioner that the claim of the 4th respondent, who is claiming to be landless poor person, was rejected by the Assistant Commissioner, Endowments Department, and same was upheld by the Revisional Authority vide Memo No.48965/Endts.IV(2)/2007, dated 13.03.2012. When the petitioner approached the revenue authorities, instead of providing assistance to the petitioner, Tahsildar, Kakinada Rural1st respondent issued impugned proceedings No.B/408/2012, dated 30.05.2012. Aggrieved by the same, present writ petition is filed.

Heard Sri G.Vasantha Rayudu, learned counsel for the petitioner and Sri N.Bharat Babu, learned counsel for the respondents 5 to 9.

A perusal of the impugned proceedings dated 30.05.2012 shows that it is only an internal communication between the Tahsildar and the Revenue Divisional Officer, Kakinada, as such, I am not inclined to entertain the writ petition. However, this will not preclude the petitioner from taking appropriate action as per the provisions of the A.P Charitable and Hindu Religious Institutions and Endowments Act, 30/87. In fact, the petitioner has filed O.A.No.64 of 1998 and same was withdrawn with a liberty to file fresh petition.

In view of above facts and circumstances, it is for the petitioner to initiate appropriate proceedings for eviction in accordance with law.

With the above observations, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stands closed. ____________________________ A.RAJASHEKER REDDY, J 31.10.2016 kvs
