29.12.2021 LK,J I.A.No.1 of 2021 This application is filed by the petitioner to relax condition No.(ii) i.e., on such release, the petitioner/A.1 shall appear before the Investigating Officer on 1st and 3rd Saturday of every month between 10.00 AM and 5.00 PM, till completion of investigation and filing of the charge sheet, imposed in Crl.P.No.8003 of 2021, by order dated 10.11.2021. Sri C.Damodar Reddy, learned senior counsel appearing on behalf of petitioner, submits that the petitioner is suffering with severe health ailments and he has to undergo surgery to his right knee. He further submits that this Court imposed the said condition on 10.11.2021 and ever since he has been complying with the said condition. As he has to undergo surgery immediately, he cannot appear before the police regularly. Hence, the said condition may be relaxed. Learned Assistant Public Prosecutor submits that petitioner is complying with the conditions imposed by this Court.

Taking into consideration the health condition of the petitioner, condition No.(ii) is hereby modified to the extent of "The petitioner shall appear before the Investigating Officer as and when his presence is required. Further, respondent police shall issue prior notice to the petitioner and if the petitioner's health condition does not permit him, he may seek for subsequent date, which is convenient to him." Accordingly, this application is ordered.
