THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL ON No.82420F ET, ORDER:
This Criminal petition is filed under Section 43g of the Code of Criminal Procedure, L973 (for short .Cr.p.C.) by the petitioner to enlarge the petitioner/accused on bail in connection with Crime No.100 of 2023 on the file of the Dharpally police station, Nizamabad District, registered for the offences alleged under Sections 4L7, 420, 376(2)(n) and 506 of IpC and Section 3(2)(v), 3(2)(va) & 3(2)(vii) ofthe SC/ST (pOA) Act, 2015.
2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent- state. perused the record.

The second respondent filed a complaint stating that she is an Anganwadi teacher and this petitioner is a Mandal parishad Development Officer (MpDO). It is alleged that he had called respondent No.2 to the office and threatened that he would send report to the higher officials. The second respondent pleaded and when questioned, petitioner said that she should come as and when he calls her. Petitioner took her to his house and behaved indecenfly ( \ and accordingly he had exploited her sexually several times. It is I further alleged that this petitioner had brought her to Hyderabad on i I i -"'"'

promise of a private job. She tried to commit suicide for the acts of this petitioner and she was saved by her husband' When the husband insisted to know the reason, then she revealed the acts of this petitioner.

Learned counsel appearing for the petitioner would submit that there was consensual relationship which was going on since September 2021 and even according to her complaint she had travelled to Hyderabad and it was on her own and there was rlo force to travel. The circumstances clearly indicate that the second respondent was in consensual relationship with the petitioner'

As seen from the complaint, the petitioner had misused his position as Mandal Parishad Development Officer (MPDO) to sexually harass the second respondent' It is the matter for investigation to ascertain whether the relationship was consensual or not' In the background of serious allegation, this Court is not inclined to grant relief of anticipatory bail'
