THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO M.A.C.M.A.No. 1763 OF 2005 JUDGMENT:

This appeal is preferred by the claimant in M.V.O.P.No.1049 of 2001 on the file of the Motor Accident Claims Tribunal-cum-I Additional District Judge, Cuddapah. He lost two teeth and his lower lip was injured. He claimed an amount of Rs.1,04,000/- for the injuries sustained by him in a motor accident that occurred on 10.08.2001 at 2.30 p.m., when he was boarding the APSRTC bus bearing No.AP 04T 9559 of the respondent at Cuddapah to go to Badvel. The Tribunal held that the accident occurred due to rash and negligent driving of the driver of the APSRTC bus. With regard to the injuries, the Tribunal awarded an amount of Rs.5,000/- towards medical bills, though the petitioner filed medical bills for Rs.11,395/- , as the bills filed by him were not supported by any medical prescriptions. On the basis of the evidence of P.W.2, the cost of teeth was calculated at Rs.7,000/- and an amount of Rs.3,000/- was awarded towards pain and suffering.

Thus, an amount of Rs.15,000/- in all was awarded along with interest at 9% p.a. In view of the same and keeping in view the nature of wounds sustained by the petitioner, the award of the Tribunal is justified and the M.A.C.M.A. is, accordingly, dismissed.

Consequently, miscellaneous petitions, if any, pending in the appeal shall stand dismissed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 18th November, 2015 cbs
