THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.1777 OF 2017 ORDER:

This petition is filed by the petitioner-Accused No.2 under Section 438 of the Code of Criminal Procedure (Cr.P.C.) apprehending his arrest in Crime No.875 of of Jawaharnagar Police Station, Cyberabad, Medchal, for the offences punishable under Sections 420 and 493 of the Indian Penal Code (IPC) and Section 3(1) (s) of the SCs and STs (POA) Act, 1989, as amended.

Learned counsel for the petitioner, after arguing the matter for a while, requested to permit the petitioner-accused No.2 to surrender before the Judge, Special Sessions Court for Trial of Offences under SCs and STs (POA) Act-cum-VII Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar and if any application is filed under Section 439 Cr.P.C., the Presiding Officer concerned may be directed to decide the said petition on the same day.

Acceding to the request of the learned counsel for the petitioner without adverting to merits of the case, the petitioneraccused No.2 is permitted to surrender before the Special Sessions Court for Trial of Offences under SCs and STs (POA) Act-cum-VII Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar and to file an application under Section 439 Cr.P.C., after serving advance notice on the Public Prosecutor concerned, the Presiding Officer is directed to decide the application in accordance with law on the same day.
