HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.8265 of 2015 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of all further proceedings in C.C.No.468 of 2013 on the file of the XXIV Special Magistrate, Erramanzil, Hyderabad in respect of the petitioner/accused No.3.

The second respondent herein filed a private complaint under Section 200 Cr.P.C. against the petitioner along with accused No.1 and 2 for an offence punishable under Section 138 of the Negotiable Instruments Act, 1881. Though the present Criminal Petition is filed questioning the very initiation of the proceedings, the learned counsel for the petitioner pleads for dispensation of the presence of the petitioner before the trial Court as he is no way connected with the accused No.1 company and his identity is not in dispute.

Learned Additional Public Prosecutor submits that the trial in the said C.C. has already commenced and as such the question of quashing the proceedings would not arise.

Having regard to the circumstances stated above and as there is no dispute with regard to his identity, the presence of the petitioner herein, who is accused No.3 in C.C.No.468 of 2013 on the file of the XXIV Special Magistrate, Erramanzil, Hyderabad, is dispensed with except on the dates when his presence is specifically required by the Court. Accordingly, the Criminal Petition is disposed of at the admission stage. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
