- 2 - HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1478 OF 2019 ORDER :

By order dated 17.04.2019, W.P.No.7995 of 2019 was disposed of, directing the 3rd respondent-Tahsildar, to examine the claim of petitioners and to pass appropriate orders, as per law. The claim of the petitioner was to enter the details of their properties in the web register and to issue digital pass books in their favour. Alleging that the said order is not complied, this Contempt Case is filed.

When the matter is taken up, learned Government Pleader produced copy of the endorsement dated 02.11.2019 of the Tahsildar. By this endorsement petitioners were informed that they were not in possession and as per Rule 26 (6) of the A.P.Rights in Land and Pattadar Pass Books Act, 1971, the title deed or pass book should be given only to those persons who are in actual possession. Therefore, the request of the petitioners was rejected. 3.

Learned counsel for the petitioners sought to contend that there is some boundary dispute between two villages and the Mandal Revenue Officer addressed letter to the Assistant Director, Survey and land Records, Ranga Reddy District, requesting him for clarification and demarcation of lands concerning Sy.Nos.6, 8 and 10 of Dabilguda Village, Maheshwaram Mandal, Ranga Reddy District. However, this may give rise to an independent cause of action, but that cannot be a ground to hold that the respondentTahsildar has committed contempt of the orders of this Court, warranting initiation of contempt proceedings.

Thus, leaving it open to the petitioners, to work out their remedies, on the issue, this Contempt Case is closed. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 28th February, 2020 Rds
