According to the petitioners, they purchased the land to an extent of Ac.0.18 guntas by different sale deeds in the year 2012, forming part of Sy.No.120/1 of Garimilla, Mancherial Mandal. Petitioners now allege that Government is undertaking construction of two bedroom houses by encroaching into the land purchased by them and thereby causing hardship and suffering to them.

On the last occasion, when the matter was taken up for consideration, and after hearing the learned counsel for petitioners, it was noticed that the land which petitioners claimed is in Sy.No.120/1 and the adjacent land of the Government is in Sy.No.128. Unless the boundaries are determined and the land is identified, it cannot be said straight away that the Government has encroached into the private land and undertaking construction. In view thereof, petitioners now filed I.A.No.2 of 2019 placing on record the applications made by them on 15.10.2019 to conduct survey in Sy.No.120/1. Petitioners also applied to conduct survey in Sy.No.128. However, for the present, only relief to conduct survey of land in Sy.No.121/1 is granted in order to ensure that the extent of land and demarcation of land of petitioners can be identified first, before ascertaining as to whether the Government encroached into the land belonging to them. Therefore, Writ Petition is disposed of, directing the Mandal Revenue Officer (3rd respondent) to conduct survey the land in Sy.No.120/1 of
Garimilla, Mancherial Mandal, Mancherial district, in terms of the applications made on 15.10.2019, receipts of which are filed as material papers at page nos.7 to 10 to I.A.No.2 of 2019, bearing TSTS Limited Nos.AA3396412, AA3396413, AA3496417 and AA3396419, in the presence of petitioners, within a period of three weeks from the date of receipt of copy of this order. Pending miscellaneous petitions shall stand closed.
