ORDER

Heard Sri Sarath Kumar, learned counsel for petitioners and learned Assistant Government Pleader for Assignment. The petitioners prefer the following relief:

"for the reasons stated in the accompanying affidavit, the petitioners prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents 2 and 5 in insisting the petitioners to vacate from their respective house and site properties in Survey No.103/5 of Visannapeta Revenue village and Mandal of Krishna District, as illegal, irregular, irrational, violative of Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to interfere in any manner with petitioners' said house and site properties and pass such other orders or order as this Hon'ble Court may deem fit and proper in the circumstances of the case." Mr.

Sarath Kumar submits that notices in fact have been issued after the writ petition is filed. However, the respondents are proceeding in the matter without firstly affording reasonable opportunity to the petitioners and secondly not examining the record in this behalf.

respondents 2 to 5 will act in the matter strictly in accordance with law.

Mr.Sarath Kumar requests three more weeks time to file explanation/additional explanation to the notices served on the petitioners. The same is not opposed by the learned Assistant Government Pleader.

Hence, the Writ Petition is disposed of. The petitioners are given three weeks time from today to file explanation/additional explanation to the show cause notice communicated in this behalf. It is open to the respondents to pass orders in accordance with the record and law within a period of six weeks thereafter. It is made clear that this Court has not considered the merits of the matter and at the same time expects respondents 2 and 5 to independently consider and pass orders. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
