THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6426 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.4 in the event of his arrest in Crime No.107 of 2020 on the file of Station House Officer, Valigonda Police Station, Rachakonda registered for the offences punishable under Sections 306, 494 and 498-A read with Section 109 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act.

Heard learned counsel for petitioner/Accused No.4 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that the deceased is the wife of Accused No.1 and she was married to Accused No.1 in the year 2009. At the time of marriage the deceased parents gave dowry i.e. 10 of tulas gold, 15 tulas of silver and cash.

This petitioner is the sister-in-law of the deceased and sister of Accused No.1. The allegation against this petitioner is that she was harassing the deceased for additional dowry along with other accused.

Learned counsel for the petitioner submits that Accused Nos.1 to 3 are living separately and this petitioner is the resident of Nagole, Hyderabad.

In the said circumstances, since the petitioner is already married, working as Bus Conductor and living at Nagole, she can be granted the relief of anticipatory bail subject to conditions. 7.
Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.4 shall be enlarged on bail in the event of her arrest subject to the following conditions:
i) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Valigonda Police Station, Rachakonda within one week from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.
ii) The petitioner/Accused No.4 shall appear before the concerned Station House Officer on every 1st and 3rd Sunday between 10.30 AM and 01.00 PM for a period of two (02) months and thereafter as and when required.
iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 8.
As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
