THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3356 OF 2015 ORDER:

The petitioners have preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) challenging the order dated 04.11.2015 passed in Crl.M.P.No.646 of 2014 in S.C.No.214 of 2013 passed by the V Additional Metropolitan Sessions Judge, at Hyderabad, whereby the learned Judge dismissed the petition filed by the petitioners herein seeking to discharge them in S.C.No.214 of 2013 arising out of the offences under Sections 365, 366, 506 IPC read with Section 34 IPC.

Heard and perused the material available on record. After arguing for some time by the learned counsel for the petitioner, when this Court expresses its opinion that this Court is not inclined to interfere with the order passed by the Court below, he confined his arguments with regard to dispense with the presence of the petitioners before the Court below. Considering the nature of allegations and also as the question of identity of the petitioners/A.1 to A.5 does not arise, the presence of the petitioners/A.1 to A.5 before the trial Court is dispensed with except on the dates when the trial Court insists for their appearance. The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 05.01.2016 pln
