HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 IN/AND CRIMINAL PETITION No.6670 of 2019 ORDER:
1) The petitioners, who are accused in crime No.92 of 2019 on the file of Women Police Station, Warangal (Urban), filed this Criminal Petition under Section 482 Cr.P.C. to quash the proceedings in the above crime for the offences punishable under Sections 498-A & 506 IPC. The accused No.1 is being represented by his brother-A.4 as GPA holder as per the GPA agreement executed by A.1, which has been placed on record. 2) During pendency of the Criminal Petition, I.A.Nos.2 and 3 of 2019 came to be filed by the second respondent to record the compromise and to compound the offences. Along with the petitions, a joint memo came to be filed, inter alia stating that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the compromise.
The said joint memo has been supported by the affidavit of the second respondent. In view of compromise arrived between the parties, a demand draft drawn on Axis Bank, Toli Chowki Branch, for a sum of Rs.4,00,000/ - is handed over to the defacto complainant by the accused, to which she acknowledges to have received the same towards full and final settlement as per the matrimonial settlement deed dated 20.09.2019 which has been filed along with the criminal petition and the same shall form part of the record.
3) Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioners.
4) In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.2 and 3 of 2019 are ordered.
5) Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in crime No.92 of 2019 on the file of Women Police Station, Warangal (Urban), against the present petitioners are hereby quashed.
