HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.23041 OF 2019 ORDER:

This Writ petition is filed seeking to declare the action of the 3rd respondent - Station House Officer, Meerpet Police Station, Rachakonda District, in calling the petitioners to the police station in relation to Crime No.634 of 2019 dated 18.09.2019 registered on the complaint lodged by the 4th respondent, who is the father of the 1st petitioner, as illegal and unjust.

2. Heard Sri Shaik Saifullah, learned counsel for the petitioners, and learned Assistant Government Pleader for Home, and perused the material on record.

3. Learned Assistant Government Pleader for Home submits that though it is the case of the petitioners that petitioner No.1 is a major and has entered into marriage with petitioner No.2 on her free will and volition, since a missing complaint has been lodged by the 4th respondent before the 3rd respondent authority, petitioner No.1 may be directed to appear before the 3rd respondent authority with necessary proofs to establish that she is a major and that her marriage was on her free will and volition.

4. In view of the aforestated submission, this Court is of the view that on appearance of the petitioner before the 3rd respondent authority, furnishing such documents to establish her age to be major and making necessary statements before the 3rd respondent authority,

the 3rd respondent shall record the same, prepare a report and submit the same before the Court concerned for further action in the matter. If the 1st petitioner makes any statement as to her marriage being without her consent or under threat or coercion, the 3rd respondent authority is at liberty to take necessary steps by initiating necessary action against the 2nd petitioner or any other person directly or indirectly involved in the matter.

5. With the observations as above, the Writ Petition is disposed of. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the writ petition stand closed.
