THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.13 OF 2016 ORDER:
The present criminal revision case is filed by the petitioners challenging the order, dated 09.10.2015, passed in Crl.M.P.No.197 of 2014 in D.V.C.No.16 of 2014 by the Court of the XXV Metropolitan Magistrate, Kukatpally, Cyberabad, at Miyapur, whereby the Court below allowed the petition filed by the second respondent herein directing the petitioner herein to pay an amount of Rs.10,000/- (Rupees ten thousand only) towards rent for accommodation to the second respondent and her minor daughter; and Rs.15,000/- (Rupees fifteen thousand only) per month to the second respondent herein for her minor daughter. Heard and perused the records.
Learned counsel for the petitioner submits that the petitioner herein is unable to pay the amount of Rs.10,000/- towards rent for accommodation and Rs.15,000/- towards monthly maintenance to the minor daughter of second respondent herein and as such, prays this Court to reduce the maintenance amount. Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions. (i) The petitioner herein is directed to pay 50% of the amount ordered towards rent for accommodation and also 50% of the maintenance amount ordered by the Court below, i.e., Rs.5,000/- (Rupees five thousand only) per month and Rs.
7,500/- (Rupees seven thousand and five hundred only) per month to the second respondent herein on or before 10th of every succeeding month; (ii) The petitioner is also directed to pay the arrears of rent for accommodation as well as maintenance amount calculating at 50% of the amounts ordered by the Court below, within a period of three months from the date of this order; and (iii) The trial Court is directed to dispose of D.V.C.No.16 of 2014 as expeditiously as possible, preferably within a period of six months, without being influenced by the order of this Court.
With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
