HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7343 of 2006 ORDER:

This writ petition was filed challenging the action of the respondents in laying road across the land of the petitioner in an extent of Ac.13.12 cents in Sy.No.131 of Lomada village, Simhadripuram Mandal, Jammalamadugu Revenue Division, Kadapa District, without following due process of law.

2. A counter-affidavit is filed by the 5th respondent stating that there is already an existing road and the black top was laid on the existing road and it did not require any acquisition of the land or widening of the road. It was also stated that they have been following the G.O.Ms.No.24 dated 03.02.2005 for maintenance and improvement of the existing road. 3.

In view of the statement made by the respondents in their counter-affidavit that no acquisition of the land or widening of the road is involved in the black top existing road, this Writ Petition is closed. No order as to costs.
