HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22457 of 2010 ORDER:

This writ petition was filed challenging the action of the respondents in creating centers contrary to the provisions of the University o f Hyderabad Act, 1974 and the statutes made there under and also allotting teaching faculty positions and funds to such centers.

This Court by order dated 21.09.2010 directed that the interviews for the posts, which were advertised, may go on and the candidates selected for the posts in regular departments of the University may be appointed in accordance with the relevant rules. However, the orders of appointment for the posts, which are allotted to the centers where no regular teaching activity is being undertaken, shall be deferred.

Some of the selected candidates approached this Court and sought impleadment and their applications for impleadment were ordered.

Now, the learned Counsel for the petitioners submits that the University of Hyderabad addressed a letter to the petitioners with reference to the 120 OBC posts to the teaching departments stating that the University of Hyderabad, is keen to re-distribute the positions among the teaching Schools/Departments/Centers based on the requirements, subject to disposal of the writ petition.

5. In the light of the aforesaid letter, the learned Counsel for the petitioners does not want to pursue the present writ petition, but seeks liberty to approach this Court in case the University of Hyderabad does not implement the allocation of specially

sanctioned posts to the teaching departments/Schools in future. 6.

Reserving such liberty, the Writ Petition is closed. However, in view of the closure of the writ petition, the University o f Hyderabad is at liberty to issue appointment orders, in accordance with the notification, to the selected candidates. No order as to costs.
