ORDER:
This Contempt Case was filed alleging willful disobedience to the order dated 13.06.2012 passed by this Court in W.P.No.17326 of 2012. By the said order, this Court set aside the punishment imposed upon the petitioner under proceedings dated 17.01.2012 and remitted the matter to the Disciplinary Authority for
determining the appropriate punishment to be imposed on him in accordance with the relevant regulations.
It is now stated by the learned Standing Counsel that the Disciplinary Authority issued proceedings dated 15.11.2012 imposing the punishment of fixation of the petitioner's salary at the minimum time scale. A copy of the said proceedings is also placed on record.
Though Sri A.G.Satyanarayana Rao, learned counsel for the petitioner, would contend that the punishment imposed is not in accordance with the regulations and further, a copy thereof was not served on his client, it is not for this Court to examine these aspects in exercise of contempt jurisdiction. The grievance of the petitioner, if any, in connection with the proceedings dated 15.11.2012 would necessarily have to be redressed by way of independent proceedings and cannot be made the subject matter of this Contempt Case.
The Contempt Case is accordingly closed leaving it open to the petitioner to avail appropriate remedies in accordance with law if he is aggrieved by the subsequent proceedings dated 15.11.2012. No order as to costs. _______________ SANJAY KUMAR, J va
