P.Baba Imran Ali Khan, v. The State Of Andhra Pradesh
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.1032 OF 2016 BETWEEN P.Baba Imran Ali Khan and others ... PETITIONERS AND The State of Andhra Pradesh, rep. by its Principal Secretary and others ...RESPONDENTS Date of Order pronounced: 18.01.2016 ORDER:- Heard.
2. On the request of the petitioners survey was proposed to be conducted and respondent No.5 is stated to have issued two notices dated 23.06.2015 and another notice dated NIL fixing the proposed survey on 04.07.2015 and 01.12.2015 respectively. The said notices are stated to have been given to the petitioner as well as to the other neighbouring land owners. However, the survey, as such, was not conducted. Aggrieved by the inaction, the present writ petition is filed.
3. In view of the fact that already steps are taken by the fifth respondent
to conduct survey by fixing the survey on two different dates, as mentioned above, there is no reason why survey is not yet completed.
4. Hence, the writ petition is disposed of directing respondent Nos.4 and 5 to ensure that the proposed survey is conducted as early as possible after issuing notices to all the concerned landholders including the petitioners and submit the survey report to the competent authority preferably within two months from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
