HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.4044 of 2015 ORDER:

The petitioner, who is A-4, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.207 of 2014 of Kodumur Police Station, Kurnool District registered for the offences punishable under Sections 323, 506, 384 r/w.34 IPC.

The case of the prosecution is as under:

The informant lodged a report stating that his father borrowed an amount of Rs.30,000/- from A-2 and gave to one Laxman Kumar, who issued IP notices about one year back. In that regard A-2 and A-3 are alleged to have demanding the father of the informant to pay the amount. A panchayath was conducted in the office of one Raghunath Reddy.

On 12-09-2014 at about 1 pm the petitioner is said to have called the informant's father to come to Raghunatha Reddy's office at Kodumur to do panchayath with regard to payment of amount of A-2 and A-3. Thereafter, A-2, 3 and 5 took away the father of the informant to the office of one Raghunatha Reddy and alleged to have beat him with hands and legs apart from taking away the promissory note. At that time the petitioner is alleged to have beat the informant. Basing on these allegations the above case came to be registered. Heard the learned counsel for the petitioner and the learned Public Prosecutor for the State and perused the material on record. A reading of the First Information Report (F.I.R.) would show the presence of the petitioner at the time of incident. He beat the informant with hands along with others.

It is stated that A-2, A-3 and A-5 were already arrested and released on bail. Having regard to the circumstances stated above, the petitioner, if so, advised shall surrender before the concerned Court and move an application for bail after giving notice to the Public Prosecutor, in which event, the Court concerned shall deal with the same in accordance with law on the same day having regard to the fact that A-2, A-3 and A-5 were already released on bail.

Petition is disposed of.
