THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6437 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused in the event of his arrest in Crime No.141 of 2022 on the file of Station House Officer, Ghanpur Police Station, Warangal District registered for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for petitioner/Accused and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that the de facto complainant purchased Ac.03-10 guntas of agricultural land from this petitioner and the said land is in possession of the de facto complainant. However, this petitioner was entering into the land of the de facto complainant stating that Ac.0-03 guntas of land was not sold and it belongs to him and he was continuously troubling by placing stones saying that they are the boundaries for his Ac.0-03 guntas of land. The father of the de facto complainant was threatened by this

petitioner when he objected to the petitioner placing stones in the land. Thereafter, the de facto complainant's father committed suicide by consuming pesticide.

Learned counsel for the petitioner submits that the petitioner is aged around 72 years and it is a land dispute and even according to him he wanted his part of land i.e. Ac.0-03 guntas which is not sold.

The only allegation against this petitioner is that he had threatened the de facto complainant's father that he would kill him if he enters into his land, and without going into the factum of the ownership of the land, the petitioner can be granted the relief of anticipatory bail subject to conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused is directed to surrender before the Station House Officer, Ghanpur Police Station, Warangal District within one week from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of

Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of four (04) weeks and thereafter as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
