THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 979 of 2011 Order:
When the matter is taken up for hearing, it is represented by the learned Additional Public Prosecutor that in the instant crime the investigating agency has filed a final report as long back as on 11.07.2011 stating that there is mistake of fact and, therefore, nothing survives for adjudication in the Criminal Petition and the matter has become infructuous.
Accordingly, the Criminal Petition is dismissed as having become infructuous.
As a sequel thereto, the miscellaneous petitions, if any, pending in the Criminal Petition shall stand closed.
