Danthuluri Srirama Raju v. The State Of Telangana, Rep.By Its Principal Secretary,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5908 of 2015 ORDER:
The writ petitioner is aggrieved of the action of the 1st respondentrevisional authority in not passing orders in the revision or in the stay application filed by him against the orders of the 2nd respondent, dated 24.01.2015.
2. The averments in the writ affidavit are to the effect that the 3rd respondent-Special Deputy Collector took up LTR proceedings against the petitioner and passed eviction orders on 20.01.2006. Challenging the same, the petitioner filed an appeal before the 2nd respondent-Additional Agent. But the 2nd respondent, by orders dated 24.01.2015, confirmed the eviction orders of the 3rd respondent. Impugning the orders of the 2nd respondent, the petitioner filed a revision petition before the 1st respondent, and along with the revision, he filed a stay petition seeking stay of eviction orders. The petitioner's grievance is that the 1st respondent has neither disposed of the Stay application nor the Revision.
3. Heard the petitioner's counsel and the learned Government Pleader.
4. Considering the fact that the Revision as well as the Stay application are pending before the 1st respondent, this writ petition can be disposed of by directing the 1st respondent to dispose of the Stay application, or preferably the Revision itself, within a period of four months from today. Till such time the Stay Petition or the Revision, whichever is earlier, is disposed of, there shall be Stay of eviction proceedings against the petitioner.
5. With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed. ________________________ CHALLA KODANDA RAM, J 10th March, 2015 ksm
