THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.12403 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 2nd respondent allowing the 3rd respondent in making illegal construction of G+3 floors and consequently to direct the 2nd respondent to remove the unauthorized construction of G+3 floors in a 200 Sq. yards site situated at D.No.26-746/6082 on Plot No.80 in Sy.Nos.306 P, 311 P and 900 P with plinth area of 666.66 Sq. ft of Manmole Village, RC-Puram Mandal, Medak District."

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that respondent No.2 is not removing the unauthorized construction made by respondent No.3.

Learned Standing Counsel appearing for the Greater Hyderabad Municipal Corporation submitted that if the construction made by respondent No.3 is illegal in nature or is made without obtaining permission from the Corporation or if there is any deviation to the sanctioned plan, the Corporation will take appropriate action in accordance with law. 5.

Recording the submission of the learned Standing Counsel, the Writ Petition is disposed of directing respondent No.2 to take appropriate action in accordance with law regarding the illegal

construction alleged to have been made by respondent No.3 as expeditiously as possible. There shall be no order as to costs. 6.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
