Jajimoggala Appa Rao, v. The State Of A.P

THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No.15387 OF 2016 ORDER:

Vide the present petition, the petitioners/A.1 & A.2 seek direction, thereby relaxing the conditions imposed on the petitioners/A.1 & A.2 in Crl.M.P.No.2773 of 2016 dated 14.10.2016 on the file of the Metropolitan Sessions Judgecum-I Additional District & Sessions Judge, Visakhapatnam. While enlarging the petitioner/A.1 & A.2 on bail, the Metropolitan Sessions Judge directed the petitioners to execute a personal bond for a sum of Rs.50,000/- each with two sureties each and the sureties shall furnish a fixed deposit of Rs.50,000/- each to the satisfaction of Judicial First Class Magistrate, V. Madugula and the sureties shall furnish their attested copies of the Aadhar Card.

Keeping in view the averments made in the instant petition and the submissions of learned counsel for the petitioner and the learned Additional Public Prosecutor, I hereby modify the order in Crl.M.P.No.2773 of 2016 dated 14.10.2016 and direct the Metropolitan Sessions Judge to enlarge the petitioners/A.1 & A.2 on bail on executing a personal bond for a sum of Rs.50,000/- with two sureties of equal sum to the satisfaction of the Judicial First Class Magistrate, V. Madugula.

It is needless to state that the sureties shall furnish their attested copies of Aadhar card and the bail is subject to verification of genuineness of the residence and the other details of the petitioners/Accused as well as sureties. I further modify the said order that the petitioners/A.1 & A.2 shall appear before the concerned police station as and when called till the investigation is completed and charge sheet is filed.

With the above direction, this Criminal Petition is partly allowed. No costs.

Miscellaneous Petitions, if any pending, shall stand closed.
