ORDER:

The grievance of the petitioner is only to the extent of non-consideration of appeal by the second respondent, though the said appeal was preferred on 25.09.2013 seeking cancellation of ROR patta passbooks issued in favour of respondents in the appeal relating to Ac.19.15 guntas in various survey numbers in Janampeta Revenue village, Pinapaka Mandal, Khammam District.

2. Learned Government Pleader has received instructions, which state that the appeal could not be disposed of as interlocutory applications are pending.

3. However, since the appeal was filed on 25.09.2013, there is no justification for keeping the appeal pending. Hence, the second respondent is directed to fix an early date for hearing the appeal after notice to all the parties and pass appropriate in the said appeal, in accordance with law, preferably, before end of December 2015. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. ______________________ VILAS V.
