HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19784 of 2011 ORDER:

Heard learned counsel for the petitioners and learned counsel for the respondents. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

The present writ petition is filed seeking issuance of a writ of mandamus declaring the inaction of the fourth respondent in demarcating the house plots assigned to the petitioners and others as per lay out laid by them to facilitate for construction of houses in their respective allotted plots being sanctioned by the second respondent, as illegal and arbitrary and consequently direct the fourth respondent to visit the lay out site situated in Sy.No.431 of Endluru Village and decmare the plots as per lay out.

Though the learned counsel for the petitioners raised various issues, he restricts his argument stating that the representations which have been made by the petitioners may be disposed of at the earliest.

He submits that number of representations were made by the petitioners for conducting survey in respect of the land in Sy.No.431 of Endluru Village after payment of necessary fees. He further submits that though the representations were made long back till date no orders have been passed.

On the other hand, the Government Pleader submits that in

respect of the very same land civil suits are pending before the Civil Court, as such the question of demarcating the land does not arise.

The grievance of the petitioners is only with regard to nonconsideration of their representations. Without going into the merits of the case, the writ petition is disposed of by directing the fourth respondent to dispose of the representations made by the petitioners with regard to conducting survey in respect of plots belonged to them, in accordance with law, if the same are still pending, within a period of eight (08) weeks from the date of receipt of a copy of this order. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
