THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39576 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to give a direction to respondent No.3 not to interfere in the civil matters of the land in the possession and enjoyment of the petitioner to an extent of Ac.8.71 cents in Sy.No.51/1 and 2 and Ac.5.28 cents in Sy.No.52-2 situated in Jannavaram Village, Golugonda Mandal, Visakhapatnam District. 2.
The main grievance of the petitioner is that respondent No.3 is interfering in the civil disputes pending before the petitioner and respondent No.5 and he is asking the petitioner to hand over his possession and enjoyment of the aforesaid land to respondent No.5.

Heard and perused the material available on record. 4.
Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that the petitioner was never asked to hand over the possession of the aforesaid land to respondent No.5 and respondent No.3 will not interfere in any of the civil disputes pending before the petitioner and respondent No.5.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:
Respondent No.3 is hereby directed not to interfere in any of the civil disputes pending before the
petitioner and respondent No.5. At the same time, the present order will not stand in the way of respondent No.3 to proceed with the investigation if any complaint is registered against the petitioner for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
