HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 2539 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 16.01.2004 issued by the 3rd respondent including the charge sheet dated 23.08.2003 issued by the Depot Manager, Dharmavaram, as illegal and arbitrary. A consequential direction is also sought to set aside the orders of reversion to the post of Superintendent (T) permanently from the post of Assistant General Manager (Traffic).
Learned counsel for the petitioner submits that during pendency of the writ petition the petitioner has attained the age of superannuation and there was no interim suspension of the impugned orders of reversion dated 16.01.2004 and that though the petitioner preferred an appeal against the orders of reversion to the appellate authority on 29.01.2004, but so far the appellate authority has not passed any orders on the said appeal.
This Court having considered the said submission is of the considered view that the writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents seeking to set aside the orders of reversion.
Accordingly, the writ petition is disposed of directing the petitioner to submit a fresh representation to the respondents seeking to set aside the orders of reversion dated 16.01.2004, within two weeks from the date of receipt of a copy of this order, and upon
receiving such representation, the respondents shall consider the same and pass appropriate orders thereon in addition to the appeal preferred by the petitioner on 29.01.2004, within four weeks thereafter, in accordance with law.
