THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6676 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A5, seeking to grant anticipatory bail in Cr.No.98 of 2019 on the file of Saidabad Police Station, Hyderabad District, registered for the offences under Sections 143, 144, 147, 324, 332 read with Section 149 IPC. 2.

Heard learned counsel for the petitioner/A5, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the complaint that on 25.03.2019 at about 23.30 hours, on information, the Sub-Inspector of Police along with his staff reached to Zakeer Hussain Colony and found the mob of Hindu and Muslim community people unlawfully restricting the traffic and pelting stones against each other, meanwhile, night duty officers along with force reached the spot and controlled the situation. 4.

Learned counsel for the petitioner/A5 submits that the petitioner has been falsely implicated in the crime with an intention to harass him and that the allegations in the remand case diary are all vague and general. He further submits that out of six cases registered against the petitioner, he was acquitted in four cases and that 5th case is at crime stage and 6th case is pending for trial. He further submits that the petitioner is law abiding citizen and the police have implicated him without there being any material on

record and he is ready to abide by the conditions imposed by this Court.

Learned Additional Public Prosecutor vehemently opposed the bail application stating that six cases have been registered against the petitioner on earlier occasion and whenever such an incident happened, the petitioner actively participated and played important role in similar type of crimes and thus, he is not entitled for anticipatory bail.

As seen from the criminal history of the petitioner/A5, it is found that six cases have been registered against him in Cr.Nos.410 of 2004, 126 of 2012, 128 of 2012, 130 of 2012, 133 of 2012, and 30 of 2019 of Saidabad Police Station. In all these similar type of crimes, the petitioner was actively participated. Thus, in view of the nature of allegations leveled against the petitioner and his involvement in similar crimes previously, this Court is not inclined to grant anticipatory bail to him and his prayer for anticipatory bail is refused.

Hence, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
