HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.864 of 2009 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, for the following relief: " To declare the action of the respondents in not implementing the provisions of the Act i.e., THE BUILDING AND OTHER CONSTRUCTION WORKERS (REGULATION OF EMPLOYMENT AND CONDITIONS OF SERVICE) ACT, 1996 (for short 'the Act') and the rules made thereunder, as arbitrary and illegal, and violative of Articles 14, and 21 of the Constitution of India and consequently, direct the respondents to implement the Act and rules made thereunder in full by framing the detailed schemes as contemplated under the provisions of the Act for the welfare of the building and other construction workers."

When the matter is taken up for hearing, learned counsel for the respondents submitted that as per the interim order passed by this Court on 17.12.2009, the respondents are implementing the provisions of the Act, and hence, the nothing survives for adjudication in the matter. Recording the same, the Writ Petition is disposed of as infructuous. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
