THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6459 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.178 of 2022 on the file of Station House Officer, Chevella Police Station, Chevella-Cyberabad registered for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioner/Accused was arrested on 09.05.2022 on the allegation of abetting suicide of his brother-in-law. The facts of the case are that this petitioner was harassing his wife for property and the said issue regarding the property was taken before the village elders. However, the petitioner did not change his attitude and continued to harass his wife, for the said reason, the deceased who is the brother-in-law committed suicide for the reason of his sister's life would improve, if he had committed suicide.

Learned counsel for the petitioner submits that there is no allegation in the complaint that this petitioner was involved in harassing the deceased directly.

As seen from the record, since the investigation is almost complete, this petitioner/Accused can be granted the relief of bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Chevella.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
