THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33996 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of respondent No.2 in interfering with the rights of the petitioner at the instance of respondent Nos.3 and 4 herein yielding to the pressures brought out by them through the dispute between the petitioner and respondent Nos.3 to 5 herein, which is civil in nature, and directing the petitioner to settle the same with respondent No.3 and also trying to settle the civil dispute even though he does not have any authority as illegal and arbitrary. 2.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that the petitioner was never called to the police station by respondent No.2 and respondent No.2 will not interfere in any of the civil disputes pending before the petitioner and respondent Nos.3 to 5. 4.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.2 is hereby directed not to interfere in any of the civil disputes pending before the petitioner and respondent Nos.3 to 5. At the same time, the present order will not stand in the way of respondent No.2 to proceed with the investigation if

any complaint is registered against the petitioner for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
