THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.5262 OF 2009 ORDER:

This Writ Petition is filed to declare the action of respondents 1 to 4 in trying to merge Andhra Jateeya Khalashala with Krishna University and allot the land of Andhra Jateeya Vidya Parishad in favour of the fifth respondent-University, as contrary to the provisions of the Endowments Act.

The petitioner claims to be the member of the family of the founder of the fourth respondent-institution. He is aggrieved by the action of the respondent-authorities in proposing to amalgamate the fourth respondent-institution with the fifth respondent-University.

This Court granted interim direction on 17.03.2009 in W.P.M.P.No.6877 of 2009 directing the petitioner to file a detailed representation before the first respondent indicating all his objections for amalgamation of the fourth respondent-institution with the fifth respondent-University and on such representation being filed, the first respondent is directed to consider the same and pass appropriate orders. It was further observed that till such time, no final decision shall be taken in the matter. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

Learned counsel for the respondents submits that the proposal to amalgamate the fourth respondent-institution with the fifth respondent-University is still pending consideration and no action has been taken whatsoever.

In view of the same, the Writ Petition is disposed of, directing issuance of notice to the petitioner and the fourth respondent, if there is any proposal to amalgamate the fourth respondentinstitution with the fifth respondent-University. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
