THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.14619 of 2016 ORDER:

The petitioner prays for Mandamus declaring the action of respondents in dispossessing the petitioner from an extent of Ac.3-51 cents in Sy.No.138/ 20 of Z.Chintuva Village, Rambilli Mandal, Visakhapatnam District, as illegal and unconstitutional. On 27.04.2016, this Court passed the following interim order :- " Pending further orders, respondents shall not dispossess the petitioner from the subject property without following due process of law."

Learned Assistant Government Pleader for Assignment places on record written instructions dated 28-06-2017 of 4th respondent, which read thus :- " It is humbly submitted that the writ petition filed is a premature one that too filed with surmises and presumptions only. The respondents Government assure that, the writ petitioner will not be dispossessed from subject land without following due process of law in the event of acquiring/ resumption of land for the purpose of Special Economic Zone. In the above circumstances, it is therefore, prayed that the Hon'ble Court may be pleased to dismiss the Writ Petition." From the above, it is clear that the respondents are accepting the assignment in favour of petitioner and have gone on record by stating that possession of petitioner is not disturbed except in accordance with law.

By placing the above statement on record, the writ petition is ordered accordingly. No order as to costs.
