UMA DEVI WRI T PETI TI ON No. 41005 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the borrower assailing the order dated 21.11.2016 passed by the Debts Recovery Tribunal, Hyderabad, in S.A.No.497 of 2016. This order was admittedly passed by the Tribunal in relation to the possession-cum-auction sale notice dated 21.10.2016. Sri D. Raghavulu, learned counsel for the petitioner, would fairly admit that subsequent to the passing of the aforestated order by the Tribunal, the DCB Bank Limited, the first respondent, conducted the auction sale of the secured asset on 04.08.2017 and that steps have already been taken by his client for amending the prayer in S.A.No.497 of 2016 pending before the Tribunal.
In that view of the matter, the cause in this writ petition in relation to the earlier order dated 21.11.2016 passed by the Tribunal in the pending Securitisation Application no longer survives for consideration on merits.
The writ petition is accordingly dismissed leaving all issues open. Interim order dated 25.11.2016 shall stand vacated.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
